I placed my order a few months ago. However, if enough people are complaining, I would be surprised if PayPal doesn't investigate, despite the transaction history.

I am about to throw in the towel and ask for my money back. I have a large enough collection I should be able to trade for what James failed to deliver. I am sure I have an extra tree that was on your list and vice versa .Lets start a new trade thread to recover our loses from James. Fair well Green fin.

This is a genius idea. I have 3 BM's and 5 i-258's I'm trying to root, and a black mission. I also have a golden Celeste, an improved Celeste, and just a Celeste on its way.

@nunuorig  Just pm'd you... beware of cuttings from dausername1... Sorry....

Lewi, sorry for misunderstanding the situation, you were making an accurate generalization. The tissue culture part threw me a little bit. But what about it? Isn't it worth asking James about tissue culture? If we were using this thread to talk about growing and James was comfortable maybe it would have already come up a long time ago. If that is his #1 seller it might be worth the initial investment, as long as Agristarts agrees to give him sole propagation rights. I don't know the specifics about that stuff though so maybe you are right and it is not an option, or one that nobody would be willing to believe anymore.

I don't understand exactly what James means about propagating that many trees/cuttings that fast or what his plan is. There is no question that James is behind and has been over optimistic before. I can't say it is impossible, he is right though that figs can be multiplied exponentially. If he learned to bud graft and did some of the extra plants that nobody wants anymore would that work for anyone? It is a real bummer that communication is shut down, especially now that things have gotten really serious.

OK, so it looks like we agree that 1500 Black Madera from 40+ small trees is "not likely".

This is a small start in the right direction, we actually agree on one aspect.

My paypal claim status is 'Deferred' because it is already more than 180days.
I've email James with 'Refund' subject 10days ago, also no respond received until today.
Advice please.

Advice...hmmm

You could pray James W Sperman gets hit by the perverbial lightning bolt from heaven, and starts to do good deeds...and ships your order...

Or you could look into your state AG, his states AG, small claims court, local Sherrif, BBB, etc.

KS has very lenient bankrupcy laws, and I'm sure his Business is incorperated in a state that has good corporate BK laws.

I too am way past PP protection period, and was warned by good people early on in this thread about that issue. But I had purchased from him in the past (before figcuttings dot com) those worked out well, so I was a believer.

Well, not quite. I said I don't know enough about what he meant or is doing. I've never gone for mass propagation either. I trial varieties for fruit production, but sure, many of the trees (small, newly rooted cuttings) I planted last year in June had made 20+ linear feet of growth within 4 months. That is without additional fertilizer, pruning, and not in a tunnel, from June to October, water stopped in September. So when I say it is not impossible I meant that, it is possible but hard for me to understand because I don't know the specifics. Unless some people succeed in getting James locked up and homeless he will be able to set the market price of BM and most other varieties within a short period of time. Many varieties would be much more affordable if there wasn't so much competition and psy-ops from the "figs are my retirement plan" side of the argument that has pushed many people away.

It is easy to be confident when you don't know what it is that you don't know. Figs will make a liar of all of us, those of you who don't believe it are already there.

Could you please answer one thing for me Lewi? Why did you say TC was not an option? It breaks my heart to see people here walling in and tearing down their fellow growers...

Just checking in. No word or response from James.  No refund of my three orders.  It's been about 2 weeks now.

I had 2 phone calls across 3 departments with ebay about dausername1 cuttings I bought. I googled him and found he was a scammer, and I too had problems leaving a negative complaint. So from my call with customer service, they understood my complaint with not being able to mark him negative and they tested it and found that to be true.

Next I spoke with the fraud department. They read the fake positive complaints. They also searched all the users with dausername1 email addresses and found about 15 accounts linked to the same address. They understood the issue about selling fake cuttings and how people wouldn't realize until the plant... if the plant even grew.

They credited me the full purchase, are suspending all the guys accounts, and are going to refer dausename1 to law enforcement once they complete their investigation.

Thank you tsparozi for the warning!!!!

Now if I can only figure out what type of fig cuttings he actually sent me!!

Impressive.  By the way, you are misusing the term "complaint" to mean "feedback."  A complaint is always negative, so a negative complaint is redundant and a positive complaint is impossible.

Adipose,

Did you request your refund through his email posted on the fig cuttings website.

PM's did not work. I sent to the Gmail address with my Pay pal account name, date and amount.

Took @ 3-4 days.

Let me know if this helps please. I am still out there with hope and faith too.

It has been long for an update

Thanks, Mike.

Mike, the first thing I did was email.  No response to date.  That was on April 11.

A few days later I sent the PM that was suggested in this thread, but that got no response either.

I guess the next step would be PayPal, even if it is beyond their stated limits because this is an ongoing situation.

I may be right behind but keep asking myself " what would he do with what he has?"

Professional  Optipessimist I guess.

Lol, funny when you make up a word and spell check doesn't even try to correct it.

Enjoy the season and good luck everyone.

Mike

I would say get your orders in now. My guess is as soon as these start shipping and people receive them he is going to get lots of orders.

I really like thinking positive.

Fig people are cool. Thanks for posting.

Mike

I ordered my trees in October 2016. E-mails about shipping dates in March went unanswered. I found this forum in early April. I requested a refund (as described by others here) April 10th. I asked again for a refund, again, NO ANSWER, NO REFUND!!!

It is past 6 months, so Pay Pal cannot file a dispute. I made sure they understood that I am not the only customer that has not received the product that I paid for. Pay Pal advised me to speak with my credit card company, they have the authority to deduct the purchase amount from the vendors Pay Pal account.

I just spoke with my credit card company. They said they usually have a 120 day window of filing dispute on a transaction. But, since the vendor had made it clear shipping was not going to begin until spring, the bank will allow a dispute complaint to be opened.

I filed a complaint with https://www.ic3.gov/default.aspx  The lack of communication with customers is unacceptable.

I have watched the recent videos. For those of you that see them as a ray of sunshine and hope for trees that will be arriving, I'm glad they make you feel better. I guess I am too skeptical, because to me they are just versions of the Emperor Has No Clothes. I would bet money that the trees shown in the videos will not be shipped but used for more propagation material. Many should have been shipped weeks ago and are now too tall and fragile to be shipped without a great deal of careful packaging. The video of packaging and shipping trials just about made me scream at my monitor because those trials should have been performed MONTHS ago, not in April! I do hope those who are patient and willing to wait, eventually get their trees. I am throwing in the towel on this.

I hate to come in here sounding like I am defending James. I have nothing against the guy but some of the comments just don't make sense.
You ordered tree in Oct of last year and you obviously knew they wouldn't ship until this year. No one ships in march, just so you know. I have ordered from several online nurseries and they always wait until the weather breaks. Stark was the earliest this year and shipped 3 weeks ago.

At best James is a few weeks late and its obvious he is working on the shipping details. The lack of communication is a problem but I don't see him as screwing anyone yet.

I can tell you I asked for and received a refund months ago and then spent that money on cuttings. Some are doing well, others are doing nothing at all. Big money cuttings too so you may be waiting but its better than spending money and not knowing if you will ever get them to root.

As James gets close it looks like there is going to be one last ditch effort to try and bring him down.

I suspect the reason refunds have stopped is because he is close to shipping and  has probably already spend a ton of money getting to this point. Money for shipping is probably still there. Everyone was aware of the fact that he was doing a startup with the money. My guess is your wait will be rewarded soon.

I placed my order on Jan 4th, nothing was shipped of course, on April 23rd I have opened a paypal case, of course no response.. On the 28 I have escalated to Paypal for refund....
He will get shut down soon enough by paypal due to business practices.

Just an observation...

whenever there is a positive comment about James...some newbie comes out with negative comment...
when you bought trees from James...you did not make it a public knowledge ,you did it privatley, so you want your money go do it the same way you ordered...PRIVATELY....
I hope you get your money...

Anyone hear about Chinh Ngo, aka Andy?  He has a shop called USA Gardens on https://www.etsy.com/shop/USAGarden

Is he legit?  He's got a billion types of cuttings.

No, but I heard of Chung Hwa pencils.

Okay fellow members let's keep the fire under James butt please, He has procrastinated long enough, way past what I was led to believe.Has anyone checked to see the last time he has visited this site?

Again, I really do hope all of Jame's supporters do get their trees and cuttings. I'm not wishing him to fail on your account. He is fortunate to have people who still have faith in him.

When I came across Greenfin's website and placed my order in October I was willing to wait until spring, which is now. I did so, because I had no idea nobody from 2016 had yet to receive an order. Unless I missed it, I have not yet heard that one customer has received an order of cuttings, or otherwise. Am I wrong?

I gave up when I found this forum only to discover there are unfulfilled orders from 2015 and its now the end of April and still no orders have arrived. How on earth can all the orders for 2016 be honored and filled and yet I would have still receive my order this spring? Physically impossible when James isn't hiring any staff and is doing it by himself. Whoever believes he can fulfill all of the pending orders even this year is living in a fantasy world.

I find it very interesting that people are encouraging customers to place more orders. Why would somebody do that unless they think they will get a payoff? Perhaps ensuring there is enough funds to ship your orders?
